These General Terms and Conditions of Sale (hereinafter "GTC") govern the sales of products made on the Sticky Pad® website, accessible at https://www.stickypad.fr, between:

1. OBJECT
These Terms and Conditions define the rights and obligations of the parties in the context of the online sale of Sticky Pad® products.
All orders imply full and complete acceptance of these Terms and Conditions.
2. PRODUCTS
The products offered are those listed on the Sticky Pad® website, subject to availability.
Each product is presented with a description that is as accurate as possible.
Slight variations may exist, without engaging the Seller's liability.
3. PRICE
Prices are shown in euros (€).
These prices do not include delivery charges.
VAT is applied in accordance with applicable legislation or not applicable depending on the tax regime
Sticky Pad® reserves the right to change its prices at any time, without retroactive effect.
4. ORDER
The customer places their order directly on the Sticky Pad® website.
All orders are considered final after:
Payment validation
Receipt of a confirmation email
Sticky Pad® reserves the right to refuse or cancel any order in the event of an existing dispute with the Customer.
5. PAYMENT
Payment is due immediately upon ordering.
The accepted payment methods are those offered on the website at the time of purchase.
Payments are secured through specialized providers.
Sticky Pad® does not store any banking data.
6. DELIVERY
Delivery details are specified in the Delivery Policy available on the website.
Sticky Pad® ships internationally.
Delivery times are given as a guide and may vary depending on the destination and carriers.
Any customs fees and taxes are the sole responsibility of the Client.
7. RIGHT OF WITHDRAWAL
In accordance with the legislation in force in the European Union, the Customer has a period of 14 days from receipt of the product to exercise their right of withdrawal.
⚠️ The right of withdrawal does not apply to the following products:
Used, tested or washed
Having lost their adhesive properties
Incomplete or damaged returns

8. RETURNS AND REFUNDS
Returns are subject to the conditions set out in the Return Policy – Sticky Pad®.
Return shipping costs are the responsibility of the Customer, except in the case of an error attributable to the Seller.
Refunds are issued to the original payment method after inspection of the product.
9. RESPONSIBILITY
Sticky Pad® cannot be held responsible:
Due to misuse of the product
Use on an incompatible surface
Failure to comply with instructions for use
The Seller's liability is limited to the amount of the order.
10. WARRANTY
The products benefit from the legal guarantee of conformity and the guarantee against hidden defects, in accordance with legal provisions.
Sticky Pad® commercial warranty
In addition to the legal guarantees of conformity and hidden defects, Sticky Pad® offers a 3-year commercial guarantee on its products.
This warranty covers manufacturing defects under normal conditions of use, in accordance with the product recommendations.
The warranty does not cover:
Normal wear and tear of the product
Misuse
Use on incompatible surfaces
A lack of maintenance or cleaning

11. PERSONAL DATA
Personal data is processed in accordance with the GDPR.
The Client can consult the Privacy Policy to learn about the terms and conditions for processing their data.
12. INTELLECTUAL PROPERTY
The Sticky Pad® brand, content, visuals, texts and logos are the exclusive property of SPARTE.
Any reproduction or use without authorization is prohibited.
13. FORCE MAJEURE
Sticky Pad® cannot be held liable in the event of force majeure or any event beyond its control.
14. APPLICABLE LAW – DISPUTES
These Terms and Conditions are governed by French law.
In the event of a dispute, an amicable solution will be sought before any legal action is taken.
Failing that, the competent courts will be those within the jurisdiction of Montpellier.
15. CONSUMER MEDIATION
In accordance with Articles L.612-1 et seq. of the Consumer Code, the Customer has the right to use a consumer mediator free of charge in order to resolve amicably any dispute between him and Sticky Pad®.
After a prior written request to customer service has gone unanswered or unsatisfactory within 30 days, the Customer may contact the following mediator:

16. EUROPEAN ONLINE DISPUTE RESOLUTION (ODR) PLATFORM
In accordance with Article 14 of Regulation (EU) No 524/2013, the Client is informed that they may also use the European online dispute resolution platform:

17. OBJECTION TO TELEPHONE SOLICITING
In accordance with Article L.223-2 of the Consumer Code, the Customer is informed that they can register free of charge on the telephone marketing opt-out list:
18. ARCHIVING – EVIDENCE
Sticky Pad® archives purchase orders and invoices on a reliable and durable medium, constituting a faithful copy in accordance with legal provisions.
The Seller's computerized records shall be considered authentic between the parties.
19. PARTIAL NULLITY
If one or more provisions of these Terms and Conditions were declared null and void or unenforceable, the other provisions would remain in full force and effect.
20. MODIFICATION OF THE TERMS AND CONDITIONS OF SALE
Sticky Pad® reserves the right to modify these General Terms and Conditions of Sale at any time.
The applicable terms and conditions are those in effect on the date of the order.
